Sale or Purchase of Commercial Property

My background is in litigation, and I approach every commercial real estate transaction with an eye to avoiding future liability. Working closely with buyers or sellers, I address:

  • Clear title — I ensure the property is free of liens and otherwise fit for disposal. This includes any restrictions in leases with current tenants affecting the ability to sell or the desire to purchase. I can handle negotiations with tenants, including notification of sale and release to sell, and right of first refusal to lease under new ownership.
  • Due diligence — I perform the thorough leg work to address environmental issues, private and city inspection reports, zoning and land use restrictions, and construction contracts. I take action to clear any legal barriers to the transaction.

Lease Negotiations

I represent commercial property owners, tenants, or property management companies in all commercial leasing matters:

  • Existing tenants — I can sort out the landlord/tenant issues when a new owner is taking over a property, protecting the interests of the lessor or the current lessee.
  • New leases/renegotiation — Commercial real estate is at a premium in Greenwich and Fairfield County. In representing lessees, I research comparable lease rates to ensure that the rent is competitive. I also negotiate all terms, including net lease vs. sharing of taxes and utilities.
